MONTGOMERY — Kay Ivey on Monday signed House Bill 95, known as the Alabama Post-Election Audit Act, establishing a statewide process for conducting post-election audits aimed at strengthening voter confidence and ensuring the accuracy of election results.
According to state leaders, the new law requires every county in Alabama to perform an audit following each general election. The process will include reviewing one countywide race and one statewide race from a single precinct in each county. Audits will begin no earlier than 31 days after an election, or after the deadline to file an election contest has passed, and must be completed within 30 days.
“Alabama has long set the standard for free, fair and secure elections,” Ivey said. “And with this law, we are strengthening that foundation even further by adding another layer of transparency. Folks can rest easy knowing there is no funny business when it comes to their vote being cast in an Alabama election.”
Under the legislation, probate judges will oversee the audit process in their respective counties and submit findings to the Alabama Secretary of State’s Office. Those results will be made publicly available online.
Each report will detail any discrepancies discovered, their likely causes, and recommendations for improvements. The Secretary of State will compile the statewide findings and provide a report to both the Legislature and the Governor.
The law also includes provisions designed to increase transparency, requiring public notice of audit times and locations. This allows poll watchers and members of the media to observe the process.
Joe Lovvorn, the bill’s sponsor, said the measure is intended to reinforce trust in the state’s election system.
“This legislation strengthens the integrity and transparency of Alabama’s elections by ensuring an added layer of accountability after every general election,” Lovvorn said. “By implementing a consistent post-election audit process, we are reinforcing public confidence in our election results.”
Jay Hovey, who carried the bill in the Senate, said the act provides a clear framework for verifying election outcomes.
“The Alabama Post-Election Audit Act is a commonsense step to help verify the accuracy of our election outcomes and ensure continued trust in the election process,” Hovey said. “This law provides a clear and transparent framework for auditing election results, ensuring accuracy while maintaining an efficient and orderly process that voters can trust.”
Officials emphasized that the audits are not intended to change certified election results but instead to evaluate the accuracy of election equipment and procedures.
The new law builds on prior efforts to enhance election security in Alabama, including legislation signed in 2021 that authorized a limited post-election audit following the 2022 general election.
The Alabama Post-Election Audit Act takes effect immediately.
