Alabama Attorney General Marshall Joins Fight for Religious Liberty and School Choice at U.S. Supreme Court

Montgomery, AL – Alabama Attorney General Steve Marshall has joined a coalition of attorneys general in filing an amicus brief with the U.S. Supreme Court, reaffirming his stance on religious liberty and school choice. The brief addresses two significant cases from Oklahoma that will determine whether states that provide funding to charter schools can exclude religiously affiliated institutions.

The legal dispute stems from the Oklahoma State Supreme Court’s decision to block a Catholic virtual charter school from operating due to its religious affiliation. The attorneys general argue that this ruling is unconstitutional, asserting that states should not be allowed to deny public benefits to schools based on their religious mission.

“Religious liberty is the cornerstone of our great nation, and our coalition will stand firm as a safeguard against governments that discriminate against religious institutions. We will relentlessly fight to ensure that the highest court in the land upholds the right of schools to not be denied public benefits based on religion,” stated Attorney General Marshall.

This case aligns with Attorney General Marshall’s broader advocacy for religious freedom and expanded educational opportunities. The outcome could have nationwide implications for school choice policies and the role of religious institutions in publicly funded education.

The U.S. Supreme Court is scheduled to hear oral arguments on April 30. The brief, led by South Carolina, is also supported by attorneys general from Arkansas, Florida, Georgia, Kansas, Louisiana, Missouri, Montana, Nebraska, Ohio, and Texas.
