NOTICE OF SALE OF SURPLUS CITY PROPERTY

Notice is hereby given by the City Council of the City of Weaver, Alabama, to sell to the highest bidder, by sealed bids, the following parcel of real property:

That certain lot or parcel of land situated in the State of Alabama, Calhoun County, City of Weaver, and more particularly described as follows:

Beginning at a capped rebar at the Northwest corner of said quarter-quarter, thence North 89 degrees 56 min. 36 sec. East along the North line of said quarter-quarter 582.94 ft. to a capped rebar on the observed West line of the Chief Ladiga Trail (aka. former railroad right of way); thence South 09 degrees 23 min. 45 sec. West along said West line, being a curve to the left with radius of2755.96 ft. a chord length of 492.22 ft.; thence South 02 degrees 25 min. 09 sec. West along said West line 209.28 ft. to a capped rebar. thence South 01 degrees 11 min. 06 sec. West 30.09 ft. to a capped rebar; thence South 01 degrees 11 min. 06 sec. West along said West line 438.63 ft.; thence South 03 degrees 00 min. 34 sec. West 178.81 ft. to a capped rebar; thence North 87 degrees 42 min. 00 sec. West and leaving said West line 479.56 ft. to a capped rebar; thence North 00 degrees 11 min. 43 sec. East 1322.10 ft. to the point of beginning. Containing 15.54 acres, more or less.

According to B.G. Bailey’s, Reg. No 12502, survey of the described land conducted on February 14, 2020, on the report and map of which it is identified as Tract A.

The City will convey the property by statutory warranty deed “AS IS, WHERE IS” with no express or implied warranties.

The City will accept sealed bids for the property until 4:00 PM, Friday December 22, 2023. The MINIMUM bid amount acceptable to the City is Fifty Thousand and 00/100 Dollars ($50,000.00).  Any bids received for less than $50,000.00 will be immediately rejected as non-responsive.  Bidding instruction and the Offer to Purchase Form are attached. All bids must be made on the Offer to Purchase form provided by the City and placed in an envelope with the words “Sealed Bid” and the Parcel Identification Number written on the envelope. Bids shall be delivered to the Weaver City Hall, C/O Mayor Jeff Clendenning, 500 Anniston Street, Weaver, AL 36277.

At 4:00 PM, Friday December 22, 2023, all bids received shall be opened in public and the amount of each bid recorded. The record of bids shall be reported to the City Council at their next regularly scheduled work session/council meeting on Tuesday, January 9, 2024.

The Weaver City Council will determine the highest responsible bidder for the property and will award the bid upon Council Approval on Tuesday, January 23, 2024.

To be responsible, a bid must be made on the Offer to Purchase form provided by the City, placed in an envelope with the words “Sealed Bid” and the Parcel Identification Number written on the envelope, and be accompanied by a bid deposit of five percent (5%) of the amount of the bid. A bid deposit may take the form of cash, a cashier’s check, a certified check, or a money order. The deposit of the bidder to whom the award is made will be held until of the property is closed; if that bidder refuses at any time to close the sale, the deposit will be forfeited to the City. The deposits of other bidders will be returned at the time the Weaver City Council awards the property to the highest responsible bidder.

The City reserves the right to withdraw the property from sale at any time and the right to reject all bids.

BIDDING INSTRUCTIONS

Important Property Information: The City of Weaver makes no representations as to unforeseen circumstances on the property or the exact property boundaries. PROPERTIES ARE SOLD “AS IS”. It is up to the bidder to verify the property with regard to size, zoning, development potential, structural and mechanical issues, etc., to the extent the bidder is satisfied and understands what is being required.

Submitting a Bid for Purchase:

  1. A bid for City-owned property must be submitted in writing on a City of Weaver Offer to Purchase form and must include a five percent (5%) bid deposit. Please read the form, which includes standard provisions and restrictions.
  2. The MINIMUM bid amount acceptable to the City is Fifty Thousand and 00/100 Dollars ($50,000.00).Any bids received for less than $50,000.00 will be immediately rejected as non-responsive.
  3. Please allow this correspondence to serve as my (“Purchaser”) “Offer to Purchase” for the Purchaser’s acquisition of the parcel of property declared as “surplus” by the City of Weaver.    Should the City accept the terms and conditions as proposed herein, I will anticipate a formal Purchase Contract for our final negotiation and execution.
