Aniah’s Law Hearing Held for Oxford Robbery/Attempted Murder Defendant

Calhoun County, AL – An Aniah’s Law hearing was held on Tuesday, October 21, 2025, at the Calhoun County Courthouse in Anniston for a defendant charged with first-degree robbery, attempted murder, and certain persons forbidden to possess a firearm. The hearing was presented to the court in front of Judge Randy Moeller.

Terrell McCain appeared in court for the hearing related specifically to the robbery charge stemming from his arrest on October 16, 2025, where he is accused of using a firearm to rob a local Oxford smoke shop (see original story).

During the hearing, Calhoun County District Attorney Lynn Hammond questioned Oxford Investigator Austin Pitts regarding his involvement in the investigation. Investigator Pitts gave testimony that he was one of the investigators who spoke with McCain at the police department after he was taken into custody. Inv. Pitts explained that McCain was read his Miranda rights and still chose to speak with the investigators in the interview room. During his testimony, it was learned that McCain stated he had spent all his money at a Mexican restaurant and made the decision to rob a store to secure more money. McCain proceeded to the smoke shop, retrieved a semi-automatic handgun, and entered the building. He approached the store clerk, demanded money from the victim, and then discharged the weapon. Inv. Pitts then advised that when the victim handed the money to McCain, he stated he was sorry and told the victim to call the police. He was still at the store when Oxford Police Officers arrived a short time later and took him into custody.

Alabama Parole and Probation Officer, Cody Tesmer, was also called by D.A. Hammond. Officer Tesmer provided testimony that McCain had been on felony probation on numerous prior occasions. He also advised the court that McCain had been instructed that he could no longer have or possess a firearm due to his convictions.

At the conclusion of the hearing, Judge Moeller addressed the court and advised he would issue a ruling within 48 hours.

District Attorney Lynn Hammond spoke with the Calhoun Journal after the hearing and stated, “As District Attorney, I have a strong stance against the illegal possession and the illegal use of firearms.” When asked about the reason for the Aniah’s Law hearing, D.A. Hammond responded, “It was due to the violence of the robbery. Not only did he threaten with a firearm, he physically discharged that firearm.”

On Thursday, October 23, 2025, Judge Moeller issued his ruling on the hearing and determined that McCain was to be held without bail. The order stated, “Bail is denied. Defendant is to be held with no bond.”
